03. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.1357 of 2025 pending in the Court of learned JMFC-V, Bhubaneswar, arising out of Bharatpur P.S. Case No.433 of 2025 for commission of offence punishable under Sections 316 (2) and 318(2) of BNS.

It is submitted by the learned counsel for the Petitioner that, admittedly, the occurrence relates to the year of 2022 and in the given facts of the present case the same ought to be weigh with this Court in considering the pre-arrest bail.

It is submitted by the learned counsel for the State that ex facie, the allegations are highly improbable in nature. Hence, the Petitioner ought not to be protected by pre-arrest bail.

Per contra, learned counsel for the State submits that the Petitioner had mens rea to commit the offence from inception. Hence, no leniency ought to be shown.

It is also brought to the notice of this Court that the Petitioner has been cited as accused for committing similar offences and the criminal antecedents are runs thus:

“1. Bharatpur P.S. Case No.192 of 2025, Under Sections 318(2)/ 318(4)/ 319(2) of BNS.

Bharatpur P.S. Case No.356 of 2025, Under Sections 326(b)/ 316(2) of BNS. 3. Bharatpur P.S. Case No.508 of 2025, Under Sections 318(4)/ 351(2)/ 3(5) of BNS. 4.Bharatpur P.S. Case No.509 of 2025, Under Sections 318(4)/ 351(2)/ 3(5) of BNS.”

This Court perused the allegations and also taking into account the criminal antecedent as noted above, this Court is not inclined to entertain this ABLAPL. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an

application for his release on bail, the same shall be considered on its own merit.

Accordingly, the ABLAPL stands disposed of.
