Heard learned counsel for the Petitioners, learned counsel for the State and learned counsel for the Informant.

The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.699 of 2020 pending in the Court of learned S.D.J.M, Khurda, arising out of Khurda P.S. Case No.200 of 2020 for commission of offence punishable under Sections 341/ 294/ 323/ 307/ 379/427/506/34 IPC.

It is submitted by the learned counsel that since omnibus allegations have been made against the Petitioners and charge sheet in the case at hand has been filed on 23.10.2020 and the injuries suffered have been

categorized as simple, they may be protected by prearrest bail.

Learned counsel for the State opposes such prayer.

It is apt to note that in the case at hand the Informant and the Injured are two different persons and taking into account the submission made by the learned counsel for the Informant that the matter has been settled inter se between the parties, this Court called upon the learned counsel for the Informant to file affidavit of the Injured.

On instruction, learned counsel for the Informant submits that the Injured is not traceable.

In view such submission, this Court proceeds to hear the matter on merit as rightly submitted by the learned counsel for the State. 6. On perusal of the injury report, it is seen that the injuries are corresponding to the allegations made and it is also brought to the notice of this Court that all the Petitioners have criminal proclivity.

Considering the same, this Court is not inclined to entertain the prayer for pre-arrest bail. However, in the event the Petitioners surrender before the learned Court in seisin in the aforesaid case and move an application for their release on bail, the same shall be considered on its own merit.
