Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.29 of 2020 pending on the file of learned Special Judge-cum-Addl. Sessions Judge, Parlakhemundi, Gajapati, arising out of Adava P.S. Case No. 66 of 2020 for commission of offences punishable under Sections 376(2)(n)/366 IPC read with section 6 of the POCSO Act.

It is stated at the Bar that the victim after attaining her marriageable age out of her own volition has married the Petitioner No.2.

Perused the instructions received from the learned counsel for the State in terms of the order of this Court dated 22.02.2024.

The instructions of the victim joining Petitioner No.2 in matrimony is taken on record.

Considering the same and that in the meanwhile charge sheet has already been filed, this Court is persuaded to hold that custodial interrogation of the Petitioners is not warranted.

Hence, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
