02. 1. Since both the matters arise out of Mahila P.S. Case No.72 of 2021, they are heard together and disposed of by this common order on the consent of the parties.

Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.855 of 2021 pending in the Court of learned SDJM(S), Cuttack, arising out of

Mahila P.S. Case No.72 of 2021 for commission of

offence punishable under Sections 498-A/ 323/ 294/ 34/ 506/ 406 of I.P.C. and u/s- 4 of D.P act.

It is submitted by the learned counsel that taking into account the nature of allegations, custodial interrogation of the Petitioners is not necessary. More so since as stated by the learned counsel for the State that in the meanwhile charge sheet has already been filed in the case at hand under Section 498-A/ 323/ 294/ 34/ 506/ 406 of I.P.C. and u/s- 4 of D.P act.

Learned counsel for the State opposes the prayer.

Taking into account the nature of allegations and filing of charge sheet, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

Accordingly, both the ABLAPLs stand disposed of.
