03. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1495 of 2025 pending on the file of learned S.D.J.M., Bhanjanagar arising out of Bhanjanagar P.S. Case No.896 of 2025 for commission of offences punishable under Sections 115(2)/118(1)/126(2)/296/324(4)/351(2)/3(5) of BNS read with Section 25(1-B)(a)/27 of Arms Act.

It is submitted by the learned counsel for the Petitioner that omnibus allegations have been made and even if the entire allegations are accepted at its face value the overt act is not attributed to the Petitioner. Hence, the Petitioner may be protected by pre-arrest bail.

Learned counsel for the State opposes the prayer for pre-arrest bail inter alia referring to the injury which according to him corresponds to the allegation.

Taking into account the nature of allegation and the submissions made, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent other than Bolagarh P.S. Case No.77 of 2021.

If it comes to the fore that the Petitioner has any other criminal antecedent than the one as noted above, this order shall not be given effect to.

It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
