operating since 1991. After coming into force of the Odisha Fire Prevention and Fire Safety Rules, 2017, the Petitioner-Cinema Hall was required to obtain a Fire Safety Certificate to run the cinema hall. It is submitted by Mr. Rath, learned counsel that the Petitioner-Cinema Hall was initially granted Fire Safety Certificate. When an application for renewal of the same was submitted, it was rejected on the ground that the renewal application lacked approved building plan. The said order was challenged before this Court in W.P.(C) No.1185 of 2022. During pendency of the said writ petition, the authority taking into consideration the notification under Annexure-A/5, granted the Fire Safety Certificate in favour of the Petitioner-Cinema Hall as onetime measure, w.e.f., 27th February, 2021 for a period of two years, which was valid up to 26th February, 2023. Before expiry of the said period, the Petitioner applied for renewal of Fire Safety Certificate. But, the same was rejected on the ground that the application did not accompany an approved building plan. A plea is taken by the Petitioner that the approved building plan has been destroyed by white ant. The Petitioner also applied for approved building plan with the Executive Engineer, P.W.D., (R & B), Sambalpur under the provisions of the Act. But, the same was rejected on the ground that such a document is not available in the said office. Burden is on the Petitioner to produce an approved building plan for renewal of its Fire Safety Certificate. In absence of the same, the Authority is not in a position to process the application for renewal of Fire Safety Certificate.
