This matter is taken up through Hybrid mode. 2. The petitioners have put to challenge an order dated 29.11.2023 passed by the Collector, Puri in Misc. Case No.01 of 2023. The said order appears to have been passed by the Collector pursuant to an order passed by this Court dated 23.11.2022 in WP(C)(PIL) No.28352 of 2022. The petitioners claiming to be poor farmers and aggrieved by the said order have approached this Court by filing present writ petition in the nature of Public Interest Litigation.

Mr. K.P. Mishra, learned Senior Counsel appearing on behalf of the petitioners after some arguments seeks permission to withdraw this writ petition with a liberty to approach the Revenue Divisional Commissioner, Central Division, Cuttack by preferring an appeal. 4. This writ petition is disposed of with the liberty as sought on behalf of the petitioners.

Learned Senior Counsel for the petitioners has submitted that keeping in mind the fact that the petitioners are poor farmers who may not be able to ably pursue their matters before the appellate authority without any legal aid, they may be provided with free legal aid.

It is observed that the petitioners shall be at liberty to approach the Secretary, District Legal Service Authority, Cuttack (DLSA) seeking legal aid whereupon the Secretary, DLSA shall take all necessary steps to ensure that if the petitioners are found entitled to

legal aid under the scheme, they are provided free legal aid.
