1. Heard Mr. Puspalaka, learned counsel for the petitioners and Mr. Patra, learned ASC for the State opposite party No.1.

No notices are issued to opposite party Nos.2 and 3 as the matter is disposed of at the stage of admission.

Considering the submission of Mr. Puspalaka, learned counsel for the petitioner that petitioners whereallottedspace at the vending zone situate at CRP, Bhubaneswar vide Annexure-1, thereafter, since action was taken to evacuate them, order dated 30^th November, 2023 vide Annexure-2 was obtained which was followed with a direction to consider their grievances and accordingly Annexure-3 was received by BMC and in the meantime, it was responded with Annexure-4 taking a decision to relocate all of them at Smart Janpath vending zone of BMC and were intimated to attend the lottery process dated 5^th February, 2024 and that with the appearances on the date fixed, representation i.e. Annexue-5 was filed with a request to relocate them at Ward No.38 CRP Square, Bhubaneswar but no decision is taken on the same till date and recording the submission of Mr. Patra, learned ASC for the State

opposite party No.1 but without expressing anything on merits of the alleged claim, the writ petition stands disposed of with a direction to opposite party No.2 to consider Annexure-5 and thereafter to take a decision thereon at the earliest preferably within a period of four weeks from today and till such time, to maintain status quo in respect of the subject matter in question.
