This matter is taken up through a hybrid arrangement.

The present Writ Petition has been filed by the Petitioner with the following prayer:

“Therefore, it is prayed that this Hon'ble Court be graciously pleased to admit the writ application, issue rule NISI in the nature of writ of mandamus or any other writ/writs as deem fit and proper calling upon the Tahasildar, Bangriposi the Opp. Party No.4 record the land in question shall not be settled in the name of the petitioner by considering the petition dtd.10.11.2023 of the Petitioner vide Annexure-15 and also taking in to consideration of the documents vide Annexure 16 to 18 within a particular period.”

submits that pursuant to the order dated 18.07.2023 passed by this Court in W.P.(C) No.35921 of 2021, the Petitioner has filed an application dated 10.11.2023/Annexure-15 for exchanging his private land in place of encroached land in question.

Learned counsel for the Petitioner further contends that as per the order of the Tahasildar, Bangriposi, the Additional Tahasildar, Bangiriposi was conducted an inquiry and submitted a report since 19.02.2024 with regard to status of the case land in connection with W.P.(C) No.35921 of 2021 filed by the Petitioner. But, till date no final decision has been taken by the Authority on the application dated 10.11.2023 filed by the Petitioner.

In view of such facts and without going into the merit of the case, the Opposite Party No.4/Tahasildar, Bangriposi is directed to take a decision on the application of the Petitioner dated 10.11.2023/ Annexure-15 in accordance with law within a period of one month from the date of production/presentation of a certified copy of this order.

Accordingly, the Writ Petition is disposed of.
