The Petitioner has filed this writ petition with the following

prayer:

“In the light of the above facts and circumstances, It is humbly prayed that this Hon’ble Court may graciously be pleased to admit the writ petition, call for the relevant records and after hearing the parties upon notice allow the same directing the opp party Tourism Department to pay adequate compensation towards the profit of 30 years lease to the petitioner for development, management and transfer of "PANTHIKA" at Bargarh which was fraudulently lease out to the petitioner with the knowledge of the opp. party the said schedule asset has already been acquired by the NHAI since 2013.

And further be pleased to quash the letter dated 11.04.2018 which has been illegally issued for the first time by the opp. party on the ground violation of the terms and conditions of lease as such no terms and conditions of the lease has been violated by the petitioner.

And further be pleased to direct the NHAI Authority to pay compensation in respect of renovation work constructed by petitioner for development and

management of schedule property as per NH Act, 1956.

And may further be pleased to pass any other order/orders as would be deem fit and proper as facts and circumstances of the case.

And for this act of kindness, the petitioners shall as in duty bound, ever pray.”

In course of hearing, learned counsel appearing for the Petitioner states that the Petitioner has already made representation before the Opposite Party No.2 vide Annexure-20, and the same may be directed to be disposed of within a stipulated time, to which learned Counsel for the State has no objection.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.2 to consider and dispose of the representation filed by the Petitioner vide Annexure-20 and pass appropriate order as early as possible within a period of three months from the date of production of certified copy of this order.
