This matter is taken up through hybrid arrangement.

Heard learned counsel for the parties.

In filing this Writ Petition, the Petitioners have challenged initiation of the OPP Cases bearing Nos. 27/2024, 28/2024, 25/2024, 32/2024, 74/2024, 26/2024 and 10/2024 as per the notice dated 03.08.2024 issued by the Estate Officer-cum-Additional Tahasildar, Berhampur.

Learned counsel for the Petitioners submits that pursuant to initiation of the above noted OPP Cases though the Petitioners have already submitted their objections, the said cases are still pending.

Additional Tahasildar, Berhampur under Annexure-3 and no eviction notice has been served on the Petitioners.

Considering the facts and submission made and since no eviction notice has been issued to the present Petitioners, the Petitioners are directed to file reply to the show cause notice dated 03.08.2024 issued by the Estate Officer-cum-Additional Tahasildar, Berhampur. However, after filing of the reply to the show cause by the Petitioners, the Estate Officer-cum-Additional Tahasildar, Berhampur shall dispose of the above noted OPP Cases within a period of two months from the date of presentation of an authenticated copy of this order.

It is further directed that till filing of the reply to the show cause notice dated 03.08.2024 issued by the Estate Officer-cumAdditional Tahasildar, Berhampur, no coercive action shall be taken against the Petitioners.

This Writ Petition is, accordingly, disposed of.
