Heard Ms.Das, learned counsel for the Petitioner and Mr.Ghose, learned AGA for the State.

It is submitted that the Petitioner is a family pension holder and her husband though worked up-to 60 years, but has not been extended the benefits of pension and retirement till such age of superannuation and his benefits has been calculated counting his age of retirement at 58 years. It is thus prayed to revise the pension and pensionary benefits of the deceased employee of the Board of Secondary Education. It is further submitted that the case of the Petitioner is squarely covered by the decision of this Court in Madhusudan Naik vs. State of Odisha & Ors. , W.P.(C) No.6353 of 2022 and batch confirmed in W.A. No.1498 of 2022.

Accordingly, the writ petition is disposed of at the stage of admission and without expressing any opinion on the merits of the case, with a direction to Opposite Parties 2 & 3 i.e. Board of
