Heard learned counsel for the petitioner, State and Mr. Patra, learned counsel for opposite party No.4.

Instant writ petition is filed by the petitioner for a direction to opposite party No.3 in particular to sanction promotional pay and Grade pay of Rs.5400/- on completion of 30 years of continuous service towards 3^rd RACP and to fix pension accordingly and to grant the arrear dues in his favour taking into account the resolution of the Finance Department on the grounds stated.

Learned counsel for the petitioner submits that the grievance of the petitioner through Annexure-3 is pending before opposite party No.3 without any decision till date.

Mr. Panigrahi, learned ASC for the State submits that he has no objection in case the representation i.e. Annexure-7 is directed to be disposed of by the concerned authority according to law.

Without expressing anything on merit of the case and considering the fact that the petitioner has already knocked the doors of opposite party No.3 with a representation i.e. Annexure-7, this Court is of the view that the same is required to be immediately attended to and examined for a decision as per and in accordance with law within a stipulated period as same would serve the purpose and meet the ends of justice.

Hence, it is ordered.

In the result, the writ petition stands disposed of with a direction as aforesaid. It is further directed that opposite party No.3 shall consider Annexure-7 and after providing an opportunity of hearing, if necessary, to pass a final order at the earliest preferably within a period of six weeks from the date of receipt of a copy of this order.

9. Urgent certified copy of this order be issued as per rules.

A copy of the order be handed over to Mr. Patra, learned counsel for opposite party No.3 for its onward intimation and early compliance.
