Mr. Bhabani Sankar Tripathy, learned counsel appearing for the petitioners submits that Govt. of Odisha, Health & Family Welfare Department through its Resolution No.3418 dated 03.02.2017 introduced a Policy for execution of agreement in the shape of Bond with the objective to retain the pass out Doctors (PG pass out Doctor) to utilise their services in the greater interest of the State. The said policy was revised by virtue of notification No.25795 dated 16.10.2019, wherein it was stipulated that PG pass out Doctors shall be deployed for two years as per Bond condition for which the Govt. have created additional Senior Residents and Tutor posts in Govt. Medical Colleges in different disciplines. It is submitted that the petitioners are Post PG Doctors of 2019-22 batch and after completion of PG, they were posted to their respective disciplines at various Medical College and Hospital in the State for their 1^st year rotation up to 30.06.2023. During the continuance of the petitioners of 1^st year rotation, further notification was

issued on 16.12.2022 stipulating therein that the decision has been taken by the Govt. for placement of the post PG Doctors to fulfil condition on counselling basis. Before completion of their two years Bond service of the petitioners as Post PG Doctors of 2019-22 batch, the Director of Medical Education Training, Odisha through its letter dated 30.04.2024 requested all concerned including all the CDM & PHOs of the State on the subject of relieve of Post PG Doctors of 2019-22 batch after completion of two years Post PG Bond Service. Referring to Annexure-8, Sri Tripathy, learned counsel for the petitioners submitted that notwithstanding the instruction by the Additional Director Medical Education & Training, Odisha to relieve the post PG Doctors of 20192022 batch by letter dated 30.04.2024, the counselling was held on 10.06.2024 in respect of 86 nos. of Post PG Doctors of the year 2019-22 batch. He also submits that the petitioners requested for cancelling the counselling. Though they submitted representation dated 03.06.2024, there has been no response.

Mr. Prasanna Kumar Mohanty, learned Additional Standing Counsel submitted that since the counselling has already been held on 10.06.2024, the petitioners may approach the opposite party no.1 with a fresh representation for consideration.

As conceded by learned counsel for the parties and on going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition granting liberty to the petitioner to file fresh representation within a period of three days hence before the opposite party no.1, who shall consider such representation along with the representation dated 03.06.2024 vide

Annexure-11 within a period of fifteen days from the date of filing of fresh representation by the petitioners.

In such view of the matter, the result of counselling already held on 10.06.2024 shall not be given effect, if not already given effect to, till the decision is taken on the representations as stated above.

With the aforesaid observation and direction, the writ petition stands disposed of.
