1 . This matter is taken up through hybrid arrangement.

2 . The Petitioner has filed this Writ Petition challenging

the action of the Opposite Parties in not paying the legitimate dues of husband of the Petitioner till date.

3 . Heard learned counsel for the Parties.

¶18

4 . Learned counsel for the Petitioner submits that the husband of the Petitioner purchased a bond from the Opposite Party No.2/ICICI Bank and to that effect he was issued with an account Payee cheque for an amount of Rs.35,523/-. Since the husband of the Petitioner was

having a saving bank account in Opposite Party No.1/SBI Bank, he deposited the said cheque in his Savings Bank account before the Opposite Party No.1/SBI Bank, which was also sent by the Opposite Party No.1/SBI Bank for clearing. But, the said cheque was returned unpaid to the husband of the Petitioner on the ground that the account number was not matching. Even the husband of the Petitioner during his life time and after his death, requested the Opposite Parties several times to pay the amount. But, till date the same has not been paid.

5 . Considering the facts and submissions made, the Petitioner is directed to approach the Opposite Party No.2/ICICI Bank by way of an application along with all the relevant documents. The Opposite Party No.2/ICICI Bank shall take steps to release the requisite amount of Rs.35,523/- (Rupees Thirty Five Thousand Five Hundred Twenty Three) in favour of the present Petitioner within two weeks from the date of filing of the application by the present Petitioner in accordance with law.

6 . Accordingly, the Writ Petition is disposed of.
