2 . The Petitioner is facing prosecution in I.C.C. Case No.30 of 2020 pending in the Court of learned S.D.J.M., Kamakhyanagar.
3 . The Petitioner was on bail, however, he did not appear before the Court below on 13.10.2023 leading to issuance of NBW against him.
4 . Learned counsel for the Petitioner on instruction from his client undertakes that his client would be appearing before the Court below on or before 15th May, 2024 and seek appropriate remedy available to him under law.
5 . Taking into consideration the above facts and submission at the Bar, the order dated 13.10.2023 passed by the learned S.D.J.M., Kamakhyangar in I.C.C. No.30 of 2020 is set aside, subject to the Petitioner paying cost of Rs.500/- to be deposited in the Orissa High Court Advocates’ Welfare Fund.
