2. At the instance of the Opposite Party No.2, the F.I.R. dated
22.04.2022 in Ranpur P.S. Case No.96 of 2022 under Sections 363
and 34 of I.P.C. came to be registered against the Petitioner. The
allegation of the Petitioner in the F.I.R. as follows:-

Brief facts of the case is that on 22.04.2022 at 8.00 PM the informant Jayadev Behera (43), S/O- Jogi Behera of village- Manapurpada, Nuagaon, PSRanpur, Dist- Nayagarh his daughter namely Roji Jadab (D.O.B dt. 28.01.2005), aged about 17 years was staying her uncle's house situated at villageSankhamula and studying in Ranpur Collage. On dtd. 19.04.2022 at about 8.00 AM she had been to Ranpur Tution and could returned back to her uncle's house. Her uncle and his family members searched for her but could traced her. He received information from reliable sources that one Bapi Pradhan, S/O-late Prafulla Pradhan of village- Purunabasanta, PS- ranpur, Dist-

Nayagarh kidnapped her daughter and concealing her somewhere else. On this incident the mother of accused Bapi Pradhan namely Ahalya Pradhan and sister Dosei Pradhan and others are involved in this case.=

The Opposite Party No.3 is the victim in this case. The

Opposite Party No.2 being the father of the victim and informant filed an affidavit dated 21.02.2024 inter alia stating that on intervention of the village gentries and well-wishers, he has settled the dispute with the Petitioner. The Opposite Party No.3 has also

filed an affidavit dated 21.02.2024 reiterating her stand regarding the fact that she has settled the dispute with the Petitioner. Therefore, both the Opposite Party Nos.2 & 3 joining with the Petitioner praying for quashing of the F.I.R.

The Petitioner and Opposite Party Nos.2 & 3 are present in the Court and being identified by their respective counsels. They have also filed the self-attested copies of their Aadhaar Cards before this Court to establish their identity, which are taken on record.

Mr. Maharaj, learned Additional Standing Counsel for the State submits that since parties have settled their dispute and both the informant-Opposite Party No.2 and the victim-Opposite Party No.3 have filed separate affidavits and they are also present in the

Court, there is no legal infirmity in quashing the F.I.R. and the consequential proceedings arising therefrom. Keeping in view the

fact that the Petitioner and Opposite Party No.3 have settled their dispute and decided to part away from each other and they are leading their respective life independently, no fruitful purpose would be served by continuing the criminal proceeding in the instance case.

Taking into consideration the aforementioned facts and submission at the Bar, the F.I.R. dated 22.04.2022 in connection with Ranpur P.S. Case No.96 of 2022 corresponding to G.R. Case No.135 of 2022 pending in the Court of the learned Additional Civil Judge (Junior Division)-cum-J.M.F.C., Ranpur and the consequential proceedings arising therefrom qua the Petitioner are quashed. 6.
