Pradeep Kumar Mohapatra Vs State of Odisha(Vig.)

This is an application under Section 483 of B.N.S.S. filed by the Petitioner for bail in connection with G.R. Case No.20/24 corresponding to Vigilance Cell Case No.8 dated 17.08.2024 pending in the Court of the learned Special Judge Vigilance, Cuttack for alleged commission of offence under Section 13(l)(b) / 12 of the Prevention of Corruption Act as Amended by Act 2018.

Learned counsel for the Petitioner submits that earlier this matter was not before any other Bench of this Court. It is submitted

by the learned counsel for the Petitioner that the Petitioner is in custody since 17.08.2024. He further contended that the custodial interrogation of the petitioner is no more required. He further submitted that the petitioner is ready and willing to abide by any terms and condition that would be imposed by this Court in the event of his released on bail.

Mr.S.K.Das, learned Standing Counsel for the Vigilance Department on the other hand, on the basis of the instruction dated 21.09.2024, submitted that no further custodial interrogation of the petitioner is required. However, he further contended that in the event this Court is inclined to release the petitioner on bail, stringent conditions be imposed so that the petitioner cooperates with the investigation and appears before the trial court on each and every date fixed.

Taking into consideration on the aforesaid submission as well as seriousness and gravity of the allegation, the petitioner is directed to be released on bail on furnishing a bail bond of Rs.30,000/(Rupees thirty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned court in seisin over the matter subject to the following terms and conditions:
