This matter is taken up through hybrid arrangement (Virtual/ Physical) mode.

This bail application under Section 439 of the Cr.P.C., 1973 of the Petitioner has arisen out of Puri Town P.S. Case No.12 of 2023 corresponding to G.R. Case No.33 of 2023 pending before the Court of learned S.D.J.M., Puri.

I have already heard from the learned Counsel for the Petitioner and the learned Addl. Standing Counsel for the State.

The Petitioner along with Gobardhan Patra @ Patro have been charge-sheeted under Section-379 & 420 of the IPC, 1860 on the allegations of commission of cheating Rs.40,000/(Rupees forty thousand) from the Informant, taking away same the same from the account of the Informant using ATM cards in the ATM counter. The co-accused of the Petitioner i.e. Gobardhan Patra @ Patro who was implicated with the similar allegations/accusations like the Petitioner has already been allowed to go on bail vide order dated 27.11.2024 passed in

BLAPL No.7784 of 2024, for which, I find no justification to disallow the bail application of the Petitioner, as his coaccused has already been allowed to go bail.

Therefore, the bail application filed by the Petitioner is allowed.

He (Petitioner) is allowed to go on bail on furnishing bail bond of Rs.50,000/-(rupees fifty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter

with conditions that:-

(i) he (Petitioner) shall not involve with similar nature of crime in future;

(ii) he(Petitioner) shall appear before the Trial Court personally in each date of adjournment of the case without fail;

¶26

(iii) he (Petitioner) shall not terrorize, coerce, influence or threat any witnesses of the prosecution including the informant and her family members either directly or indirectly in any manner whatsoever at any stage of the proceeding of the case;

(iv) the Petitioner-Manoj Kumar Sahu shall furnish cash security to the tune of Rs.20, 000/- (rupees twenty thousand) only in the shape of S.T.D.R. obtained from any Nationalized Bank initially for a period of 6 months renewable from time to time till final disposal of the case with an undertaking by the petitioner-Manoj Kumar Sahu that, the payment

of the matured amount as against the S.T.D.R. shall be subject to any order passed under BNSS, 2023 including an order under Section 395 of the BNSS, 2023 by the Trial Court; but in case of his failure to comply any of the aforesaid conditions, the Court in seisin over the matter is authorized to cancel his bail order out-rightly without seeking any permission for the same from this Court.

Accordingly, the bail application of the Petitioner is disposed of finally.
