Heard learned counsel for the petitioner and learned counsel for the State.

The Petitioner is in custody since 16.07.2024 in connection with Kaniha PS. Case No. 93 of 2024 corresponding to G.R. Case No. 458 of 2024 pending before the Court of learned S.D.J.M., Talcher for the alleged commission of the offence under Sections 341/294/323/307/506/120-B/34 of IPC.

It is alleged that four persons including the petitioner came together being armed with deadly weapons and assaulted the husband of the informant causing injuries.

This Court has perused injury report of the injured which shows that he received three injuries out of which two are grievous but said injuries are not on vital parts of the body being on the little

finger of the left hand and left ankle. The co-accused persons have been released on bail.

Considering the nature of accusations and the materials on record including the fact that the injury is not on the vital part of body, I am inclined to take a lenient view.

Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
