Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel appearing for the State-Opposite Party.

This is an application under Section 439 of Cr.P.C. filed by the Petitioner for bail in connection with G.R. Case No.49 of 2023, arising out of Adava P.S. Case No.049 of 2023, pending in the Court of the learned Sessions Judge-cum-Special Judge, Gajapati at Paralakhemundi, for alleged commission of offence punishable under Sections 20(b)(ii)C/25/29 of the N.D.P.S. Act. Read with Sections 468/471 of the I.P.C.

Learned counsel for the Petitioner does not want to press this bail application at this juncture and prays that the trial court be directed to expedite the trial and the same be concluded within a

stipulated period of time, as the Petitioner is in custody since 28.03.2023.

Considering the aforesaid submissions, while disposing of the bail application of the Petitioner as not pressed, this Court directs the trial court to make every endeavour to conclude the trial as expeditiously as possible within a period of four months hence. In the event trial is not concluded within the aforesaid period, it is open for the Petitioner to move the trial court again by filing a fresh bail application. In such event, the trial court shall consider the bail application of the Petitioner in accordance with law.
