Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.

The petitioner is in custody 03.11.2021 in connection with Mancheswar P.S. Case No. 363 of 2021 corresponding to T.R. Case No. 486 of 2021 pending in the Court of the learned 5^th Addl. Sessions Judge, Khordha, Bhubaneswar for the alleged commission of offence under Section 21 (C ) of NDPS Act.

It is alleged that the two persons including the petitioner were going on a motorcycle which was stopped by the police. On search, 273 grams of contraband brown sugar was found from its dickey. It is submitted that the independent witnesses examined during the trial have not supported the prosecution case. It is further submitted that the petitioner is required to be released at least on interim bail to attend to certain family problems that have cropped up in the meantime.

Learned State counsel submits that the official witnesses remain to be examined.

Considering the submissions as above and the materials on record, while not being inclined to grant regular bail to the petitioner, the bail application is disposed of directing the court below to release the petitioner on interim bail for a period of four weeks from the date of his actual release on such terms and conditions as may be fixed by the Court in seisin over the matter in the aforesaid case.

After expiry of the aforesaid period of three months, the petitioner shall surrender before the Court in seisin over the matter, failing which appropriate warrant may be issued for his production.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
