02. 1. Heard learned Counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with 2(a)CC (NDPS) Case No.08 of 2024 pending on the file of the learned Addl. District and Sessions Judge cum Spl. Judge, Jajpur Road, arising out of P.R. No. 51 of 2024-25 for commission of the alleged offence under Section 21(b) of NDPS Act.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Jajpur Road by order dated

20.06.2024 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the Petitioner is in custody since 05.06.2024 on the allegation that he was found to be in possession of contraband to the tune of 122gms (Heroin).

Taking into account the nature of allegation and since the motion is during the currency of investigation, this Court is not inclined to entertain the bail application of the Petitioner at this stage.

Liberty is granted to the Petitioner to renew his prayer before the learned Court in seisin post submission of charge sheet which shall be considered on its own merit.

Accordingly, the BLAPL stands disposed of.
