Mr.Santosh Kumar Mahanty, learned counsel for the petitioner submits that despite order passed by this Court, the Executive Magistrate is yet to be examined, but fact remains that the petitioner was granted liberty by this Court to renew his prayer for bail after examination of Executive Magistrate. Accordingly, Mr.Mohanty seeks permission withdraw the present bail application by praying to grant liberty to the petitioner to renew his prayer for bail, if the learned Executive Magistrate is not examined by the learned trial Court within a reasonable period. 3. In such backdrop of the submission and the circumstance of the case, the present bail application stands disposed of as withdrawn by requesting the

learned trial Court to examine the Executive Magistrate within 45 days hence and in case the Executive Magistrate is not examined within such stipulated period, the petitioner may renew his prayer for bail before this Court.
