1. This matter is taken up through hybrid arrangement (Virtual/ Physical) mode.

This bail application under section 439 of Cr.P.C, 1973 of the Petitioner arising out of S.T. Case No.38 of 2023 in connection with Champua P.S. Case No.43 of 2023 is taken up for consideration.

I have already heard from the learned Counsel for the Petitioner and the learned Additional Standing Counsel for the State.

The Petitioner is facing trial before the learned Additional Sessions Judge, Champua having been chargesheeted under section-302/201 of the IPC on the allegation of commission of murder of Arati Babanga, and also from causing disappearance of evidence.

Till yet, according to the submission of the learned Counsel for the Petitioner, 12 nos. of witnesses have already been examined by the Trial Court and the rest other witnesses are yet to be examined. When more numbers of charge-sheeted witnesses have already been examined, for which, the learned

Additional Sessions Judge, Champua is directed to take his best endeavour for completion of the trial of the case within a period of three (03) months; failing which, the Petitioner is at liberty to approach this Court again by filing bail application for his release on bail in the ground of delay in trial.

Therefore, the prayer for bail of the Petitioner is refused. 5. Accordingly, the bail application is disposed of finally and as such.
