This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with S.T. No.7 of 2022, corresponding to Tomka P.S. Case No.99 of 2021, pending in the Court of the learned Addl. Sessions Judge, Jajpur Road for alleged of offence under Sections 498-A, 302 of IPC.

Learned counsel for the Petitioner submitted that the petitioner has been languishing in custody since 15.09.2021. It is further contended that so far 21 prosecution witnesses have been examined out of 28 prosecution witnesses. On such ground, it was submitted that the petitioner is released on bail.

Learned counsel for the State submitted that there are three other witnesses to be examined.

Considering the period of detention of the petitioner in custody since 15.09.2024, the learned court in seisin over the matter is requested to expedite the trial and conclude the same within a period of two months. Prosecution shall do well to produce the rest of the witnesses as expeditiously as possible and cooperate with the court in seisin over the matter and conclude the trial at an early date. In the event trial is not concluded within the aforesaid period, it is open for the Petitioner to move an interim bail application before the trial court and in the event such interim application is filed the learned trial court shall consider the same on its own merit without being influenced by any other factor.

Accordingly, the BLAPL is disposed of.
