Order No. 01. 1. Heard Mohapatro, learned counsel for the petitioner and Mr. Tripathy, learned ASC for the State.

Instant petition under Section 439 Cr.P.C. is filed for release of the petitioner on bail in connection with G.R. Case No.791 of 2023 corresponding to Khaparakhol P.S. Case No.152 of 2023 pending in the file of learned S.D.J.M., Patnagarh registered under Sections 274, 275 and 276 read with Section 120-B IPC on the grounds stated therein.

Perused the F.I.R. i.e. Annexure-1. Gone through the chargesheet as at Annexure-2.

Mr. Mohapatro, learned counsel for the petitioner would submit that merely on the strength of the confessional statement of the coaccused, the petitioner has been implicated in the case. It has been alleged that the petitioner supplied the contraband substance,

considering which Mr. Tripathy, learned ASC, objects his release on the ground that commercial quantity of Codeine Phosphate has been recovered.

Notwithstanding other criminal antecedents and since in the meantime, chargesheet is filed with the closure of investigation and the fact that the petitioner has remained in custody since last five months, the Court is of the considered view that as other accused persons are on bail which is so revealed from the Court’s order dated 17^th October, 2023 in BLAPL No. 11689 of 2023, the accused should be allowed to go on bail with the following conditions.

In the result, the petition under Section 439 Cr.P.C. stands allowed with a direction for release of the petitioner on bail in connection with G.R. Case No.791 of 2023 arising out of Khaparakhol P.S. Case No.152 of 2023 subject to him furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with two solvent sureties for the like amount each to the satisfaction of the learned S.D.J.M., Patnagarh, who shall be at liberty to impose such other suitable conditions as deemed just and necessary in the facts and circumstances of the case besides the following, such as, he shall attend the local P.S. once in a fortnight and continue to do so for a period of six months without fail.
