This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with G.R. Case No. 184 of 2022 (T.R. No. 56/2023 FTSC), corresponding to Aska P.S Case No. 797 of 2022, pending in the Court of the learned Ad Hoc Addl. District & Session Judge (FTSC) under POCSO Act, Berhampur for alleged of offence under Sections 376-AB / 376(2)(n) of I.P.C. r/w Section 6 of POCSO Act.

Learned counsel for the Petitioner does not want to press this bail application at this juncture and prays that the trial court be directed to expedite the trial and the same be concluded within a stipulated period of time.

Considering the aforesaid submissions, while disposing of the bail application of the Petitioner as not pressed, this Court directs the

trial court to expedite trial and conclude the same within a period of three months. In the event trial is not concluded within the aforesaid period, it is open for the Petitioner to renew his prayer for bail and in the event such a new bail application is filed the same shall be considered on its own merit without being influenced by any other factor.

Accordingly, the BLAPL is disposed of.
