Heard learned counsel appearing for the Petitioner and learned Additional Standing Counsel appearing for the StateOpposite Party.

The present bail application under Section 439 of Cr.P.C. has been filed by the Petitioner for regular bail in connection with G.R. Case No.02 of 2024, arising out of Khandapada P.S. Case No.02 of 2024, pending in the Court of learned J.M.F.C., Khandapada, for alleged commission of offences punishable under Sections 294/307/323/324/341/379/385/506/34of the I.P.C.

It is submitted by the learned counsel for the Petitioner that earlier this matter was not before any other Bench of this Court. He further submitted that the Petitioner is in custody since 05.01.2024. He further submitted that the injuries sustained by the

injured are all similar in nature. In such view of the matter, learned counsel for the Petitioner submitted that the Petitioner be released on bail.

Learned Additional Government Advocate appearing for the State-Opposite Party, on the other hand, opposed the release of the Petitioner on bail on the ground of seriousness and gravity of the allegation made in the F.I.R.

Having heard the learned counsels appearing for the respective parties and considering the surrounding facts and circumstances of the case and as well as gravity of the offence and the nature of injury which is stated to be simple in nature, this Court is inclined to release the Petitioner on bail.

Hence, it is directed that the Petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(Rupees twenty thousand) with two local solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter, but subject to verification of criminal antecedent of the Petitioner as well as injury. In the event it is found by the learned court below that the Petitioner having more than one criminal antecedent or the injuries are grievous in nature, then this order shall not be given effect to.

It is further directed that the bail granted to the Petitioner is subject to depositing a cash security of Rs.2,000/- (Rupees two thousand) before the learned Court in seisin over the matter, which shall be kept in any Nationalized Bank in interest bearing account initially for a period of one year which will be renewable from time to time till conclusion of trial and the same shall be abide by the final outcome of the trial of the case.

9. The BLAPL is, accordingly, disposed of.
