Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with S.T. Case No.78 of 2021 pending on the file of learned 3^rd Additional Sessions Judge, Balasore, arising out of Khantapada P.S. Case No.305 of 2020 for commission of alleged offence under Section 302 of IPC.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 3^rd Addl. Sessions Judge, Balasore by order dated 25.01.2024 in the aforementioned case, the present BLAPL has been filed.

This is the third journey of the Petitioner to this Court. Earlier bail application of the Petitioner i.e. BLAPL No.9554 of 2020 was disposed of this Court by order dated 02.05.2022. Thereafter, Petitioner had moved this Court in BLAPL No.9239 of 2023 which was disposed of by order dated 07.12.2023.

Perused the earlier order dated 07.12.2023 in BLAPL No.9239 of 2023 whereas this Court taken note of the report submitted by the learned Court in seisin regarding progress in trial that the trial is likely to be concluded by end of May, 2024.

Since admittedly such period is not over, this Court is not inclined to entertain this bail application at this stage.

Liberty is granted to the Petitioner to renew his prayer before the learned Court in seisin, in the event trial is not concluded by end of May, 2024.

Registry is requested to communicate this order.

¶24

Learned counsel for the State is requested to ensure the presence of the witnesses to enable the learned Court in seisin to conclude the trial by end of May, 2024.

Copy of this order be made over the learned counsel for the State to impart necessary instructions in this regard.

Accordingly, the BLAPL stands disposed of.
