This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is the bail application U/S.439 of CrPC by the Petitioners for grant of bail in connection with Nayapalli P.S. Case No. 390 of 2023 corresponding to C.T. Case No.836 of 2023 pending in the file of learned JMFC-III, Bhubaneswar, for commission of offences punishable under Sections 392/34 of IPC, on the allegation of snatching away golden chain from the Informant.

None appears for the Petitioners at the time of hearing of the bail application, but Mr. J.K. Bal, learned AGA opposes the prayer for bail of the Petitioners.

It is not disputed that FIR has been alleged against unknown persons, but the present Petitioners have been subsequently remanded in this case after being arrested in another case. Further, the implication

of the present Petitioners is on the basis of recovery of golden chain. It is also revealed from the rejection order that the Petitioner No.1 is wanted in 36 criminal cases, out of which 18 cases have been committed in the year 2024 and the Petitioner No.2 is involved in 49 other criminal cases, out of which 25 cases have been committed in the year 2024.

In view of the aforesaid facts and circumstances and taking into account the nature and gravity of the allegation as raised against the Petitioners, so also their criminal proclivity, this Court does not consider it proper to grant bail to the Petitioners at this stage.

Hence, the bail application of the Petitioners stands rejected.

Accordingly, the BLAPL stands disposed of.
