The Petitioner, apprehending his arrest in connection with Dhanupali P.S. Case No.80 of 2022 corresponding to G.R. Case No.987 of 2022 pending on the file of learned SDJM, Sambalpur for alleged commission of offence under sections 143/341/332/294/ 186/283/427/435/506/149 of IPC, has filed this application under section 438 of Cr.P.C. for grant of anticipatory bail.

Learned counsel for the Petitioner submits that the Petitioner is a member of the Sambalpur Bar Association and an practicing Advocate. It is submitted that there was no premeditation and the incident had happened all of a sudden when this Petitioner, being an unlooker, has subsequently been brought to the arena of the case without being attributed with any overtact. It is further submitted that the other co-accused persons, who had

been arrested in the case, have in the meantime been released on bail and the situation in the area is absolutely normal.

Learned counsel for the State, while opposing the move, however, does not dispute that presently the situation in the area is normal and everything are smoothly functioning since long and that so many coaccused persons have been granted anticipatory bail.

Keeping in view the submissions, I have perused the records including the orders passed by this Court in several bail applications relating to the co-accused persons.

Considering the submissions made and further viewing the surrounding circumstances, I am inclined to direct that in the event of arrest of the Petitioner in connection with the above noted case, he be released on bail by the Arresting Officer on such terms and conditions as deemed just and proper.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
