Heard the learned counsel for the Petitioner and the State.

By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 498-A/294/323/307/507/34, I.P.C. in connection with Kashinagar P.S. Case No.163 of 2023 corresponding to G.R. Case No.156 of 2023 pending in the court of the learned Gramya Nyayalaya-cum-J.M.F.C., Kashinagar.

The present Petitioner is the husband of the informant. The wifeinformant namely Smt. Mandadi Manikumari appears today in the court through VC. On the query made by this Court with regard to the fact whether she is staying with her husband (the present Petitioner), she answered in affirmative by submitting that she is now living with her husband Mandadi Sekhar happily and leading a happy conjugal life and therefore she does not want to proceed further in this case, which may be closed/dropped accordingly. She

further submits that she has no objection if the present Petitioner is granted pre-arrest bail in this case.

Keeping in view the aforesaid submission made by the informantOpp.Party No.2 and considering the facts and circumstances of the case, it is directed that, in the event of arrest in connection with Kashinagar P.S. Case No.163 of 2023, the Petitioner shall be released on bail by the Arresting Police Officer on such terms and conditions as would be deemed just and proper in the facts and circumstances of the case. The ABLAPL is disposed of accordingly.
