counsel for the Petitioner has filed an I.A. bearing I.A. No.17081 of 2023 and annexing a letter dated 07.08.2019 as Annexure-6. On perusal of the said letter it appears that some of the employees have been extended the RACP benefits with a grade pay of Rs.2200/- by the Divisional Forest Officer, Rairakhol Division. In such view of the matter, learned counsel for the Petitioner submitted that the case of the Petitioner is covered by the decision of the learned Odisha Administrative Tribunal in Pitambar Dash vs. State of Odisha & ors. decided in O.A. Case No.184(C) of 2012 disposed of on 05.08.2015, which has been affirmed by this Court as well as the Hon’ble Supreme Court. In view of the aforesaid factual background, learned counsel for the Petitioner submitted that the Petitioner stands in a similar footing with the persons, namely, Pitambar Dash as well as other similarly situated persons, therefore, the ratio laid down by the Tribunal eventually affirmed by this Court as well as the Hon’ble Supreme Court is also applicable to the facts of the petitioner’s case.
