The Writ Petition involves the following prayer :- “It is, therefore, prayed that this Hon’ble Court may graciously be pleased to admit the writ application, issue notice to the Opp.Parties and be further pleased to direct the authority under the Payment of Wages Act, 1936cum-Sub-Divisional Judicial Magistrate, Jajpur to complete the proceeding pending before the court below in 2(C)CC Case No.1 of 2020 under Annexure-2 at the earliest in the interest of justice and to save the family from starvation.

And pass any other order/orders, direction/directions as this Hon’ble Court would be deem fit and proper as facts and circumstances of the case…”

In course of hearing in an attempt to expedite the completion

of the proceeding involving 2(C)CC Case No.1 of 2020, learned

counsel for the Petitioner took this Court to the entire order-sheet filed, vide Annexure-3 and reading through several orders made an attempt to establish that there has been already appearance on behalf of the Respondent so also the accused involved therein. Learned counsel for the Petitioner further submitted that there has been completion of pleading and there is no obstruction in undertaking the required exercise in completion of the proceeding involved therein.

For the learned counsel for the Petitioner establishing pleading completed through the proceeding involved herein, there is no scope for the learned Additional Government Advocate to object to such contention.

In the circumstance, this Court finds, there is satisfaction in

the request of the Petitioner for early disposal of the proceeding involved herein. This Court also finds, the proceeding involved herein is pending since 2020. This Court accordingly directs the Authority under the Payment of Wages Act-cum-S.D.J.M., Jajpur for concluding the proceeding involved herein at least within a period of three months from the date of communication of this order but however providing opportunity to all concerned.
