This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners as well as learned Additional Government Advocate.

The Petitioner has filed the present writ application with the following prayer:

“ In the aforesaid circumstances, it is humbly prayed that the Hon’ble Court may graciously be pleased to admit the Writ application and issue RULE NISI calling upon the Opposite Parties to show cause as to why the appropriate direction should not be issued to the Opposite Parties to frame a special Scheme for the Nursing Professionals for giving regular appointments for the nursing personal who had worked more than 100 days during corona pandemic keeping in view of the circular dated 03.05.2021 issued by the Government of India bearing No.Z.20015/43/2021-ME-I(FTS-8108321).

And if the Opposite Parties fail to show cause or show insufficient cause, the said Rule Nisi may be made absolute and upon hearing the parties through their counsel, this Hon’ble Court be further pleased to direct the Opposite Parties to frame a special Scheme for the Nursing Professionals for giving regular appointments for

the nursing personnel who had worked more than 100 days during corona pandemic keeping in view of the circular dated 03.05.2021 issued by the Government of India bearing No.Z.20015/43/2021-M-I(FTS-8108321).

And be further pleased to pass such other order/orders, direction/directions and/or writ/writs as it deem fit and proper in the facts and circumstances of the case.”

In course of hearing of the writ application, learned counsel for the Petitioners submits that the Petitioners ventilating their grievance have submitted representation before the Principal Secretary to Government, Health and Family Welfare Department, Government of Odisha, Opposite Party No.1 under Annexure-4. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.1 to consider the representation of the Petitioner under Annexure-4 within a stipulated period of time.

Learned Additional Government Advocate submits that he has no objection if the representation of the Petitioner is considered by the Opposite Party No.1, which is stated to be pending, in accordance with law within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party no.1 to consider the representation of the Petitioner under Annexure-4 taking into consideration Annexure3, in accordance with law, within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.1 shall do well to dispose of the representation of the Petitioner under Annexure-4 by passing a speaking and reasoned order. The decision so taken on the representation of the Petitioner be

communicated to the Petitioner within two weeks thereafter.

With the aforesaid observation, the writ application stands disposed of.
