Order No 04. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3 . The Petitioner has filed the present Writ Petition with the following prayer:-

“It is, therefore, most respectfully prayed that, this Hon'ble Court may graciously be pleased to allow this writ petition and issue writ of mandamus by directing the Opposite Party No. 2-D.D.O. to deduct the monthly loan installments from the salary of the borrower loanee-Opposite Party No. 3 against their outstanding loan amount till clear up the total loan outstanding dues.

And further direction be issued to the Opposite Party No. 2 to pass necessary order to deduct the overdue outstanding loan amount from the monthly pension of the OPP. Party No. 3, who has retired/expired in the meantime; or else necessary order may kindly be passed to deduct all outstanding dues of the Opposite Party No. 3 from the Salary of the Opp. Party No. 2, the present DDO for his deliberate violation in not acted upon his own undertaking.

And /or further be pleased to pass any other order orders, direction/ directions as this Hon'ble Court deems just fit and proper in the facts and circumstances of the present case;

And for this act of kindness, the petitioners shall as in duty bound ever pray.”

However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a detailed representation before Opp. Party No.2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence.

It is observed that if such a representation is filed within the aforesaid period, Opp. Party No.2 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by the Opp. Party No.2 be communicated to the petitioner.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
