This matter is taken up through hybrid mode. 2. Order dated 2^nd July, 2013 (Annexure-2) passed by learned 1^st Additional Civil Judge (Senior Division), Bhubaneswar in T.S. No.340 of 2000 is under challenge in this writ petition, whereby an application filed by the proforma Defendant No.5 for acceptance of his written statement, has been rejected.

Mr. Chhualsingh, learned counsel being authorized by Ms. Jena, learned counsel for the Petitioner submits that the matter has already become infructuous in the meantime. He also files a memo in support of his submission, which is taken on record.

In view of the memo filed, the writ petition is disposed of as infructuous.

Interim order dated 11^th September, 2013 passed in Misc. Case No.18700 of 2013 stands vacated.
