Heard Mr. A.C. Behera, learned counsel appearing for the Petitioner as well as Mr. D.K. Mohanty, learned Additional Government Advocate appearing for the Opposite Parties.

By means of this public interest litigation, the Petitioner has urged that the Opposite Party No.2, the Collector and District Magistrate, Mayurbhnaj, Baripada be directed to dispose of the representation of the Petitioner dated 12.04.2023, Annexure-1 to this petition, after affording opportunity of hearing to the Petitioner considering the nature of demand relating to faulty operation of the electric motor used for lifting the drinking water.

Mr. Mohanty, learned Additional Government Advocate has stated that if the said prayer is allowed, the Opposite Parties will have no objection. As such, we direct the Opposite Party No.2, the Collector and District Magistrate, Mayurbhanj, Baripada to consider and dispose of the representation dated 12.04.2023, Annexure-1 to this petition within three weeks from the date of receipt of the copy of this order after affording reasonable opportunity of hearing to the Petitioner. The Opposite Party No.2 shall send notice to the Petitioner after fixing a date for such hearing.

In terms of the above, this writ petition stands allowed and disposed of.

A free copy of this order be supplied to Mr. Behera, learned counsel forthwith.
