ORDER 02.11.2023 1. This matter is taken up through hybrid mode. 2. This writ petition has been filed for a direction to the Cuttack Development Authority-Opposite Party No.2 to take a decision on the application filed for third party transfer of Plot No.2F/696, Sector-13, CDA, Cutttack submitted by the Opposite Party No.4, in favour of one Prafulla Kumar Sethi, the deceased father of the Petitioner.

Although lengthy arguments are made by learned counsel for the parties, but in course of hearing, Mr. Nayak, learned counsel for Opposite Party No.4 and Mr. Mohapatra, learned counsel for Opposite Party Nos. 2 and 3 submit that Opposite Party No.4 has already filed an application for withdrawal of the application for third party transfer and this Court vide order of the even date in W.P.(C). No.31557 of 2023 has directed for disposal of the said application within a period of four weeks.

In view of such submission, this Court disposes of the writ petition with a direction that since an application for third party

transfer submitted by the Opposite Party No.4 is still pending with the Cuttack Development Authority, it should take a decision in the matter, keeping in mind the change in circumstances in the meantime.

Accordingly, the writ petition is disposed of with a direction to the Cuttack Development Authority-Opposite Party No.2 to take a decision on the application submitted by Opposite Party No.4 for third party transfer as expeditiously as possible preferably within a period of four weeks following due procedure of law and keeping in mind the observation made herein.
