1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State. Perused the writ petition as well as documents annexed thereto.

The present writ petition has been filed by the petitioner with the following prayers:

“The petitioners therefore, pray that your Lordships would be graciously pleased to admit this Writ petition, call for records, after hearing the parties issue writ/writs in the nature of certiorari/mandamus or any other writ/directions and quash the promotion order dated 17.07.2021 under Annexure-1 and direct the Inspector General of Police (Personnel) Cuttack to consider the grievance petition under Annexure-6 regarding validity of promotion of Opp. Party No.5 for promotion to the post of Band Havildar under Sundargarh Police District.”

It is submitted by learned counsel for the petitioner that

although the petitioner has filed representation under Annexure-6 before the Inspector General of Police (Personnel), Cuttack-Opposite Party No.3 the same is still pending before the said Opposite party and the said Opposite Party have not taken any decision as of now.

Considering the submissions made, the limited nature of grievance of the petitioner, this Court disposes of the writ petition at the stage of admission with a direction to the Inspector General of Police (Personnel), Cuttack-Opposite Party No.3 to consider the representation of the petitioner under Annexure-6 in accordance with law within a period of six weeks from the date of production of certified copy of this order. Further, it is directed that before taking final decision on the representation, it is open for the Opposite Party No.3 to provide an opportunity of hearing to Opposite Party No.5 and thereafter pass necessary order. It is needless to mention here that the representation of the petitioner shall be considered and disposed of by passing a speaking and reasoned order. Any decision so taken on the said representation shall be communicated to the petitioner within a period of two weeks thereafter.

With the aforesaid observation/direction, the writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
