1. This matter is taken up through Hybrid Mode.

2. This is an application filed by the respondent in the appeal being

MATA No. 08 of 2022 seeking modification of the order dated 17.04.2023.

3. It has been asserted that payment of the alimony could not be made within the stipulated time. On that ground, it has been urged that time for payment of alimony be extended by two weeks from today.

4. Mr. S. Pattnaik, learned counsel appearing for the appellant has

further submitted that the appellant may be directed to close the criminal proceedings.

5. Mr. S.P. Puspalaka, learned counsel having appeared for the

appellant, the opposite party in this petition, has categorically made a

¶21

statement that on payment of the permanent alimony, as determined by

¶22

the order dated 17.04.2023, the appellant shall take all steps to close the criminal proceedings or withdraw the proceedings.

6. We direct the respondent (the applicant) to make payment of the permanent alimony as quantified by the order dated 17.04.2023 by 25.07.2023 by demand draft drawn in favour of the appellant.

7. We further observe that on deposit of the said demand draft, the appellant will be entitled to receive the said demand draft for encashment

by establishing her identity by a valid document and also being identified

¶28

by learned counsel who has represented her in the appeal.

8. In terms of the above, this application stands allowed and disposed
