Heard Ms.Sahoo, learned counsel for the Appellant, and Mr.Dutta, learned counsel for the Respondent No.2

Present appeal by the Claimants is directed against judgment dated 4^th August, 2005 of 2^nd M.A.C.T., Northern Division, Sambalpur in Misc. (Accident) No.56 of 2003, wherein compensation to the tune of Rs.1,97,000/- has been granted along with interest @6% per annum with effect from the date of filing of the claim application on account of death of the deceased in the motor vehicular accident on 18^th January, 2003.

The Claimants have prayed for enhancement of compensation amount on the ground that the income of the deceased should be fixed as a skilled labourer since he was a

tailor on the date of death. The Claimants further pray for addition of future prospect to the income of the deceased.

Upon hearing both parties and considering all such grounds of challenge advanced, a further consolidated compensation of Rs.3,00,000/- is proposed to the parties in course of hearing. This is agreed by Ms.Sahoo, learned counsel for the claimants. Mr.Dutta, learned counsel for the Insurer leaves it to the discretion of the Court. As such, the amount is fixed to that extent.

In the result, the appeal is disposed of with a direction to the Insurer to deposit further consolidated compensation of Rs. 3,00,000/- (Three lakhs) before the Tribunal within a period of two months from today; where-after the same shall be disbursed in favour of the claimants-Appellants on such terms and proportion to be fixed by the Tribunal.
