In compliance to the order dated 09.02.2023, Mr. L. Samantary,

learned Additional Government Advocate obtained the instruction and files the compliance report, wherein it has been stated as follows:-

“In response to claims of the petitioner, it is humbly submitted that in obedience to the order No.07 dtd. 09.02.2023 passed by the Hon'ble High Court in CONTC.NoA7/2019 arising out of W.P.(C) No.17636/2017 has been compliance report is as detailed below.

• Provisional / Draft list of identified original affected families has been published in respect of the petitioner's village-Seepur on 02.03.2023.

• After publication of the draft list, 588 nos. of applications received from people of all the 6 (six) affected villages including the petitioner's village. All the applications have been jointly inquired from dtd.28.03.2023 to 31.03.2023. Documentation and preparation of related records alongwith entitlement matrix is under process by the concerned Zone Officer, R.I & Amin.

After verification of related records, the Zone Officer, Talcher has submitted the list of original affected families in respect of villageSeepur and accordingly entitlement matrix has been prepared and approved by the Rehabilitation & Resettlement Committee. The final list of original affected families published in the village for wide publicity. Out of 39 nos. of petitioners 22nos. of petitioners were listed in the entitlement matrix as Original Affected Families (Occupants of houses situated over acquired land) and the rest 17nos. of petitioners will be placed in the entitlement matrix as extended family after verification of records. The estimate in this regard will be submitted to the Govt. in DOWR for sanction of R&R benefits following due procedure very shortly.

Hence, it is humbly submitted that the order No.07 dtd. 09.02.2023 passed by the Hon'ble High Court in CONTC.No.47/2019 has been compiled with by the O.P.s and the present CONTC.No.47/2019 arising out of W.P.(C) No.17636/2017 may kindly be dropped.”

In view of the above statement made by Spl. L.A.R & R.O., R.I.P., Baghuabol, Talcher, the contempt proceeding is dropped. Needless to say that the Spl. L.A. R & R.O., R.I.P., Baghuabol, Talcher shall expedite the matter without keeping the same pending for years. The instruction so filed by learned Additional Government Advocate be kept on record.
