ORDER 21.07.2023 1. Heard learned counsel for the petitioner and Ms. Mishra, learned ASC appearing for the opposite party-contemnor.

Instant contempt petition is filed by the petitioner for noncompliance of the Court’s order dated 28^th November, 2022 under Annexure-1 in W.P.(C) No. 32038 of 2022 whereby opposite party-contemnor was directed to take a decision on the objection submitted by her vide Annexure-2 therein and pass appropriate order according to law.

Ms. Jena, learned counsel for the petitioner submits that the said order has not been complied with within the stipulated period of time which has long expired.

Ms. Mishra, learned ASC appearing for the opposite partycontemnor submits that a copy of the contempt petition has not

been served on her. Learned counsel for the petitioner is requested to serve the same on Ms. Mishra, learned ASC in course of the day. However, with the consent of learned counsel for the respective parties, the hearing is taken up and the matter stands disposed of by the following order.

Since there has been an order under Anenxure-1 which is for compliance of the direction considering the objection of the petitioner vide Anenxure-2 in W.P.(C) No. 32038 of 2022 and as it is claimed that the same is still pending, the Court is of the view that further time should be provided to the opposite partycontemnor to dispose of the same in accordance with law which would serve the purpose and meet the ends of justice.

Hence, it is ordered.

In the result, the contempt petition stands disposed of with a direction to opposite party/contemnor to comply the Court’s order in W.P.(C) No. 32038 of 2022 vide Annexure-1 within four weeks from the date of receipt of a copy of this order without fail and considering the submission of learned counsel for the petitioner, till such time, the order under Annexure-1 is complied with, there shall be status quo maintained vis-a-vis the schedule land.

A copy of the order be immediately communicated to the opposite party-contemnor for early compliance.

A certified copy of this order be issued as per rules.
