Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

As directed, learned State Counsel has obtained instructions to the effect that the petitioner is involved in as many as 15 cases including the offence under NDPS Act and some involving the offence under Section 307 of IPC. He however, fairly submits that the petitioner stands on the same footing as the co-accused persons, who have been granted bail by this Court.

This Court finds that the co-accused persons have been granted bail as per order passed by this Court in BLAPL No. 4719 of 2023, BLAPL No.4722 of 2023 and BLAPL No. 4723 of 2023.

Having regard to the above facts and the materials on record as also the period of detention in the custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the following conditions:

(i) He shall personally appear before the IIC of Sunabeda Police Station on every Sunday at 10 a.m. till conclusion of trial and such fact shall be certified by the IIC to the concerned Court once in a month.

(ii) He shall personally appear before trial Court on each date of posting of the case without seeking any representation.

¶24

(iii) In case of even a single default, this order shall be treated as automatically cancelled and the Court below shall issue NBW to take him to custody again forthwith.

BLAPL is accordingly disposed of.
