Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.2457 of 2022 pending on the file of learned J.M.F.C (Rural), Cuttack arising out of Jagatpur P.S. Case No.391 of 2022 for commission of offence alleged under Sections 406/506/294/34 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 3^rd Addl. Sessions Judge, Cuttack by order dated 11.01.2023 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the Petitioner and his father had taken the vehicles on lease. It is alleged that the Petitioner had not paid E.M.Is of the said vehicles.

It is the case of the Petitioner that primarily a civil dispute is being given the colour of criminality and the Petitioner has been arrayed as an accused and is custody since 14.12.2022.

It is further submitted that the co-accused has since been released on anticipatory bail by this Court by order dated 27.02.2023 in ABLAPL No.689 of 2023.

Learned counsel for the State opposes the prayer for bail during currency of investigation.

Taking into account the nature of allegation, period of custody and the punishment prescribed, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station once every month on such date and time to be fixed by the learned Court in seisin till submission of final form. Certification of such appearance shall be submitted to the Court in seisin.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
