06. 1. Since both the matters arise out of Tangi P.S. Case No.218 of 2022, they are heard together and disposed of by this common order on the consent of the parties.

Heard learned counsel for the Petitioners, learned counsel for the State and learned counsel for the Informant.

The Petitioners are accused in connection with G.R. Case No.2804 of 2022, pending in the Court of learned J.M.F.C-II, Cog. Taking, Cuttack, arising out of Tangi P.S. Case No.218 of 2022 for

alleged commission of offence under Sections 341/294/506/323/325/307/302/379/34 IPC.

Being aggrieved by the rejection of their applications for bail U/s.439 Cr.P.C. by the learned 2^nd Addl. Sessions Judge, Cuttack by order dated 14.03.2023 in the aforementioned cases, the present bail applications have been filed.

During the course of hearing, learned counsel for the Petitioners wants to withdraw the bail applications with liberty to renew their prayer before the learned Court in seisin after examination of Kalu @ Deepak Kumar Behera, C.S.W.13.

Giving such liberty, both the bail applications stand disposed of.

It is apt to note here that similar order in respect of the coaccused was passed by this Court vide order dated 24.04.2023 in BLAPL Nos.2590 of 2023 and 2591 of 2023.
