Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.

The petitioner is in custody since 07.07.2020 in connection with Binjharpur P.S. Case No.183 of 2020 Corresponding to C.T. Case No. 119 of 2020 pending in the Court of learned Sessions Judge, Jajpur for the alleged commission of offence under Sections 302/2014 of IPC.

It is alleged that the petitioner being the husband of the deceased, committed her murder by means of iron pestle. This Court rejected his earlier bail application being BLAPL No. 9822 of 2021. There is no change in circumstance warranting a different view. However, it is observed that the petitioner was granted interim bail in the present case and he has surrendered to custody. Trial is in progress. Most of the witnesses examined by the prosecution so far have turned hostile. Under such circumstances, the bail application is disposed of directing the Court below to release the petitioner on interim bail for a period of two months from the date of his

actual release on such terms and conditions as he may deem fit and proper to impose including the condition that he shall not leave the territorial jurisdiction of the Court without obtaining leave from the Court. He shall furnish his contact address and telephone number to the I.O. as well as to the Court. He shall personally appear before the trial Court on each date of posting of the case without fail. 5. BLAPL is accordingly disposed of.
