1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

The Petitioner apprehending his arrest in Rourkela Division Vigilance P.S. Case No.07 of 2023 registered for alleged commission of offences punishable under Section 13(2) read with 13(1)(c)(d) of the Prevention of Corruption Act, 1988 and Sections 420, 468, 471, 409 and 120-B of the I.P.C., has filed this petition for his release on pre-arrest bail.

Heard Mr. Saswat Kumar Acharya, learned counsel appearing for the Petitioner and Mr. M.S. Rizvi, learned Additional Standing Counsel appearing for the Vigilance Department.

Mr. M.S. Rizvi, learned Additional Standing Counsel appearing for the Vigilance Department, on instruction from the Rourkela Division, submitted that no custodial interrogation of the Petitioner is required in this case, however, cooperation of the

accused Petitioner is required for the purpose of early conclusion of the investigation.

In such view of the matter, this Court directs that in the event the Petitioner surrenders before the Court in seisin over the matter by 30^th September, 2023 and moves an application for bail, the Court in seisin over the matter shall release him on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper in the facts and circumstances of the case, subject to the condition that the Petitioner shall cooperate with the investigation and shall appear before the Investigating Officer as and when his presence is required and also produced the documents which are with him for the purpose of investigation and also appear before the trial court on each and every date of posting of the case. Violation of any of the terms and conditions shall entail cancellation of bail.

Till the date of surrender of the Petitioner as stipulated in this order, the Petitioner shall not be arrested in connection with the aforesaid case.

Urgent certified copy of this order be granted on proper application.
